MITCHELL, S.D.(HubCityRadio)- Back in January landowners held a rally prior to start of the 2026 session with the focus being on one bill and one resolution for that session. The bill was SB88 which was nicknamed the Bossly Bill and HJR5001 which would put on the ballot an amendment to forbid eminent domain for private gain.
Mitchell farmer, rancher and podcaster Amanda Radke was among those that helped organized it. KSDN had her on previewing those bills. SB88 was passed unanimously by both the House and Senate. HJR5001 was passed in the House but defeated in the Senate. Radke following the votes appeared on the KSDN Midday Report Tuesday to reflect on those results.
We started with SB88 and Radke reminded the listeners what happened to Jared & Tara Bossly back in 2023.
The bills passed out and awaiting the Governor’s signature. This hopes to bring a sense of relief to the Bossly family.
We also addressed HJR5001. At the rally in January, Radke talked about the legislative process done with this resolution. One thing she was concerned about was the risk of this becoming politicize.
Despite her concerns, the bill passed overwhelming on a 62-5 vote. The Republican vote was 61-1. The bill moved on to the Senate. Prior to that another amendment was added to it which changed the title of the bill. Radke talked about her approval of that amendment.
Radke was in the Senate chamber on Monday when debate happened on HJR5001. She discussed Senator Joy Hohn’s speech when she announced she would opposed the bill. Hohn was a landowner that was directly impacted by what Summit Carbon Solution did to them trying to get their CO2 pipeline through their property.
Radke talked about her disappointment on how some landowners were opposed and the group Dakota Rural Action who initially was in support of the resolution when it came out.
