ABERDEEN, S.D.(HubCityRadio)- U.S. District Court Judge Camela Theeler on Tuesday dismissed the case from Mary Jane Lunzman vs the Brown County Commission, Human Resources Director Allison Tunheim, and Brown County Attorney Karly Winter-Goodwin
Lunzman’s lawsuit alleged Title VII, age, and disability discrimation along with retaliation.
“The Court’s determination that the claims asserted by Lunzman in her second amended complaint against defendants are futile necessarily requires dismissal of the same claims asserted by Lunzman in her first amended complaint, which is the operative complaint. To be sure, the first amended complaint contains fewer factual allegations supporting the same claims.”
Lunzman will have thirty days to appeal the ruling.
Mary Jane’s husband Sheriff Dave Lunzman has his own lawsuit pending against Brown County Commission, the City of Aberdeen, and the Aberdeen Police Department, and then Police Chief Dave McNeil, now Aberdeen City Manager.
The lawsuit outlines 13 claims, many of which involve alleged violations of due process, selective arbitrary treatment, denial of promotion and raises, disclosure of private personnel information during a public meeting, a hostile work environment, invasion of privacy, interference with official duties, intentional infliction of emotional distress, conspiracy to deprive rights, wrongful termination and retaliation.
