PIERRE, S.D.(HubCityRadio)- The South Dakota Senate on Monday debated HJR5001. The resolution would put on the ballot would ban eminent domain for private gain.
Prime sponsor of the bill on the -Senate side was Senator Mark Lapka of Leola. He talks about the 2005 U.S. Supreme Court case invovling Kelo vs New London.
Lapka talks about what the resolution would do.
Lapka emphasize that this bill would not impact projects that would serve the public.
Senator Carl Perry spoke in favor of the bill on the floor of the Senate.
There was opposition to the bill. One was District 20 Senator Paul Miskimins who is also a farmer. He talks about issues that the various public systems still have with this.
Also speaking against the bill was District 9 Senator Joy Hohn whose property was directly impacted by what Summit Carbon Solutions was doing to her property. Hohn explains that any proposal to amend the Constitution needs to be precise.
Hohn compare HB1052 that was passed in 2025 to this resolution the Senate tried to pass in 2026.(1:10)
The South Dakota Senate voted 19-14 to defeat HJR5001.
