PIERRE, S.D.(HubCityRadio)- The South Dakota Senate State Affairs Committee heard testimony on HJR5001.
Prime sponsor on the Senate side was Senator Mark Lapka of Leola. He placed an amendment on the bill that changed the title of the bill. The bill now states “proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, requiring a declaration of necessity and clarifying public use of private property taken or damaged by eminent domain.
Lapka talks about the amendment that was added.
Lapka went over the details of the resolution.
Prime sponsor on the House side was Representative Spencer Gosch of Glenham. He talks about this will put a challenge on the 2005 U.S. Supreme Court case challenging Kelo vs New London case.
Also testifying in support was Mitchell rancher and podcaster Amanda Radke. She explains that will also impact properties within city limits.
Testifying against the bill include Brett Konecke with South Dakota Electric Utility Companies. He was concern about whether the resolution was clear enough for voters to decide.
Jordan Lamb with Oahe Electricial Cooperative discuss concerns about property rights for those who support programs versus those oppose.
Sam Nelson with Economic Development Professional Associations questions the term economic health.
Lapka rebutted claims that were made.
The committee passed the resolution on a 5-3 vote and heads to the South Dakota House.
