House Judiciary defeat HB1305

PIERRE, S.D.(HubCityRadio)- On Monday, the South Dakota House Judiciary Committee heard testimony on HB1305.  The bill prohibit the dissemination of location information about a public officer and provide a penalty and civil cause of action therefor.

Prime sponsor of the bill was Representative Brandei Schaefbauer of Aberdeen.

Schaefbauer talks about her personal experience with a blogger who she believes has been harrasing her the last few years.

Schaefbauer told leadership within the Republican Party with no action done by them.

Opposing the bill was Tara Larson, lobbyist for the South Dakota Association for Criminal Defense Lawyers who questions whether this is constitutional.  She reference the case in Colorado.

Justin Smith, lobbyist for South Dakota News Media Association who talks about what the role news media does for the city they represent.

Democrat Representative Kadyn Wittman of Sioux Falls motioned it to the 41st day and feels this bill was not necessary.

The committee sent the bill to the 41st day on a 11-2 vote.
