Bills area legislators are priming in 2026

ABERDEEN, S.D.(HubCityRadio)- Wednesday, February 4th was the deadline for bills to be introduced for the 2026 legislative session. Here’s a list of bills that District 1, 3, & 23 are listed as prime sponsors and where they stand in the legislature.  You can learn more about these bills at www.sdlegislature.gov.

District 1:

Senator Michael Rohl:

SB3: Limit the types of residential improvements for which counties, municipalities, and townships may require a permit.(Bill has been introduced and referred to the Senate Local Government Committee)

SB4: Revise procedures for returning and withholding security deposits for residential premises.(Bill passed South Dakota House on a 66-2 vote and heading to the Govenor’s Desk)

SB5: Require the disclosure of whether a ballot question was proposed by initiative or by the Legislature.(Bill has passed 66-1 and heading to the Governor’s Desk)

SB6: Reduce the duration of an individual’s reemployment benefits.(Bill was defered to 41st day on 8-1 vote on January 22nd)

SB7: Modify the tax rate on gold severed in this state.(Bill Deferred to 41st Day by Senate Taxation Committee on a  7-0 vote on January 21st)

SB110: Regulate how broadband internet access service providers use customer data(Bill refered to Senate State Affairs)

SB111: Require that social media companies provide collected personal data of a user at the user’s request and maintain transparent interoperability interfaces(Refered to Senate State Affairs Committee)

SB236: Create the county and township infrastructure fund for the accounting, safekeeping, and allocation of unobligated rural access infrastructure fund moneys.

SB238: Authorize the removal of occupants from certain short-term lodging accommodations, and to provide a penalty therefor

SJR501: Proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, limiting the number of terms an individual may serve as a member of the Legislature.(Resolution passed South Dakota Senate on 20-14 vote)

SJR502: Applying to the United States Congress under Article V of the United States Constitution to call for a convention proposing an amendment to the constitution fixing the number of justices of the United States Supreme Court at one chief justice and eight associate justices.(Resolution passed South Dakota Senate on 24-10 vote)

Representative Logan Manhart:

HB1155: Permit the state to invest in Bitcoin

HB1156: Extend each waterfowl hunting season for veterans and active duty personnel

HB1185: Require that a voter use a black ink ballpoint pen when marking an optical scan ballot.(Rep Manhart tabled the bill on Wednesday, February 4th)

HB1207: Amend the period of time before which ballots and other election materials may be destroyed following an election

HCR6002: Honoring the life and achievements of the late Charlie Kirk.(Resolution has passed South Dakota House on a 60-5 vote on January 16th.  South Dakota Senate passed it on a 31-2 vote)

Senator Carl Perry:

SB122: Establish a duty to assist in an emergency and provide a penalty therefor(Referred to Senate Judiciary Committee)

SB123: Prohibit the manufacture, sale, and distribution of any product containing cell-cultured protein, and provide a penalty therefor(Referred to Senate Agriculture and Natural Resources Committee)

Representative Al Novstrup:

HB1074: Provide for compensation to counties for administering tax increment financing districts created by a municipality.(Representative Novstrup has now withdrawn the bill Tuesday)

HB1075: Require notification of property owners prior to the establishment of a tax increment financing district.(Representative Novstrup has now withdrawn the bill Tuesday)

HB1172: Terminate certain school district excess tax levies

HB1177: Replace the index used to calculate the salaries of members of the Legislature

HB1178: Establish provisions for homeownership through shared equity agreements

HB1206: Clarify the use of public funds for the purpose of alternative instruction

HB1277: Require that campgrounds and campground additions, alterations, and modifications comply with National Fire Protection Association standards

Representative Brandei Schaefbauer:

HB1124: Establish the crime of trespass upon a place of worship, provide a penalty therefor, and declare an emergency(Bill was defeated on a 48-21 vote in the South Dakota House on Wednesday, February 4th)

HB1305: Prohibit the dissemination of location information about a public officer and provide a penalty and civil cause of action therefor

HCR008: Requesting the attorney general file a lawsuit against the People’s Republic of China and related parties to seek damages related to the COVID-19 global pandemic

District 23:

Senator Mark Lapka:

SB88: Clarify the procedure for a potential condemnor to examine real property absent the property owner’s permission.(Bill has been read and referred to the Senate Commerce and Energy Committee)

SB225: Apportion interest earnings from the unclaimed property trust fund to school districts

HJR5001: Proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, prohibiting the transfer of private property to a non-governmental entity for the purpose of economic development or increased tax revenue and requiring a declaration of necessity

Representative Spencer Gosch:

HB1076: Revise restrictions on residence within a community safety zone and to declare an emergency.(Bill passed South Dakota House Tuesday on a 66-0.)

HB1226: Authorize boards of county commissioners to adopt policies for investigating allegations of misconduct of county departments, employees, and officers

HB1290: Amend provisions pertaining to calculating local effort and state aid for general education

HB1291: Amend the process for calculating a school district’s general fund base percentage

HJR5001: Proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, prohibiting the transfer of private property to a non-governmental entity for the sole purpose of economic development or increased tax revenue.(Resolution passed South Dakota House on a 62-5 vote on Tuesday)

Representative Scott Moore:

HB1060: Remove the five percent calculation requirement from the county budgetary process.(Bill passed South Dakota House Friday on a 64-0 vote)

HB1088: Remove the requirement that counties remit to municipalities an amount equal to the road levy for calendar years 1984, 1985, and 1986.(Bill passed South Dakota House Friday on a 64-0 vote )

HB1247:  Lower the cost threshold at which a tax increment finance base must be redetermined.
