Move Over law in effect Tuesday

PIERRE, S.D.(DRGNews)- South Dakota’s updated ‘Move Over’ law requiring motorists to move over for ANY VEHICLE on the side of the road with flashing amber, yellow or blue warning or hazard lights goes into effect Tuesday.

State Department of Transportation Director of Operations Craig Smith says the new law applies to vehicles whether they are moving slowly or stopped.

Smith says DOT frequently has crews doing work along the shoulder of a road and people do need to slow down when going by.

Along with obeying the updated Move Over law, Smith reminds motorists that there’s a lot of construction work and other traffic on the roads this time of year.

A violation of South Dakota’s Move Over law is a Class 2 misdemeanor. However, there’s a stronger consequence if you don’t move over and you cause a crash.

  • On Two-Lane Roads:
    • Drivers are required to slow down at least 300 feet in advance, and reduce speed:
      • to 20 mph below the posted limit, or
      • to 5 mph if the speed limit is 20 mph or less.
