SIOUX FALLS, S.D. (Dakota News Now) – The Life Defense Fund has withdrawn its lawsuit against its opponent after a constitutional amendment to expand abortion access in South Dakota was shut down by voters.
Life Defense Fund co-chair Jon Hansen confirmed to Dakota News Now on Monday that the group has decided to drop their lawsuit.
Amendment G would have restored abortion access in South Dakota. The proposed constitutional amendment would have legalized abortion in the first trimester without state regulation.
Life Defense Fund, a pro-life group, contended that Amendment G’s sponsor, Dakotans for Health, violated state laws with improper petition circulation and that the amendment shouldn’t have been certified.
The lawsuit’s trial date, however, did not come before Election Day.
On November 5, over 58% of South Dakota voters said ‘no’ to Amendment G.
According to Life Defense Fund co-chair Leslee Unruh, this nullifies the need to continue the lawsuit.
“The people have decided, and South Dakotans overwhelmingly rejected this constitutional abortion measure. We have won in the court of public opinion, and South Dakotans clearly saw the abortion lobby’s deception. We are extremely grateful to every South Dakotan who stood up to protect women and children from danger by voting no on Amendment G,” said Unruh.
Dakotans For Health has told Dakota News Now they are awaiting a final decision from the judge.
